Terms and Conditions

These terms govern access to and use of BookingIQ, including our AI-powered receptionist, booking page, website widget, owner dashboard, alerts, and related services.

Important: BookingIQ is a software platform. It does not provide professional, medical, legal, financial, emergency, or operational advice. AI-generated responses can be inaccurate, incomplete, delayed, or inappropriate. You are responsible for reviewing, confirming, and acting on information collected through the platform.

1. Acceptance of Terms

By accessing or using BookingIQ, you agree to these Terms and Conditions. If you use BookingIQ on behalf of a business or organization, you represent that you have authority to bind that organization to these terms.

2. Description of Service

BookingIQ provides tools for businesses to create a branded booking page, install a website widget, collect leads and appointment requests, configure business information, and receive notifications. BookingIQ may use artificial intelligence and third-party APIs to process visitor messages, generate responses, summarize conversations, and route notifications.

3. Appointment Requests Are Not Confirmed Appointments

Unless a business separately confirms an appointment, any time collected through BookingIQ is only an appointment request or preferred time. BookingIQ does not guarantee business availability, calendar accuracy, service acceptance, response time, or appointment confirmation.

4. AI Limitations and Human Review

AI systems can make mistakes. BookingIQ responses may be inaccurate, outdated, incomplete, biased, or unsuitable for a particular situation. You agree not to rely on BookingIQ as the sole source of truth for pricing, availability, policies, emergency handling, medical issues, legal issues, financial decisions, or safety-critical matters. Business owners are responsible for reviewing conversations, appointment requests, and notifications before taking action.

5. Business Owner Responsibilities

  • You are responsible for the accuracy of business information, services, prices, availability rules, policies, custom instructions, and knowledgebase content you provide.
  • You are responsible for contacting customers, confirming or rejecting appointment requests, and complying with laws that apply to your business.
  • You must not use BookingIQ to collect sensitive data such as social security numbers, credit card numbers, passwords, full insurance identifiers, protected health information beyond what is necessary, or other highly sensitive data.
  • You must honor opt-out, consent, privacy, consumer protection, marketing, SMS, email, and industry-specific requirements that apply to your use of the platform.

6. Third-Party Services

BookingIQ may rely on third-party providers, including but not limited to AI model providers, hosting providers, database providers, email providers, SMS providers, analytics providers, and payment or authentication providers. We are not responsible for third-party outages, delays, errors, pricing changes, data handling, security incidents, delivery failures, or policy enforcement. Your use of BookingIQ may also be subject to those providers' terms.

7. No Emergency Use

BookingIQ is not designed for emergencies. Visitors should call 911, local emergency services, or the appropriate emergency contact in urgent or life-threatening situations. BookingIQ does not guarantee immediate routing, delivery, notification, or response.

8. Messaging and Communications

Email and SMS notifications may be delayed, blocked, filtered, undelivered, or unavailable. Carrier rules, toll-free verification, A2P registration, spam filters, and third-party provider restrictions may affect message delivery. You are responsible for obtaining required consent from recipients and honoring opt-out requests.

9. Prohibited Uses

You may not use BookingIQ for unlawful, deceptive, harmful, abusive, infringing, spam, harassment, surveillance, or high-risk uses. You may not attempt to reverse engineer, overload, scrape, resell, interfere with, or gain unauthorized access to the platform.

10. Availability and Changes

We may modify, suspend, limit, or discontinue any part of BookingIQ at any time. We do not guarantee uninterrupted or error-free operation, and we are not liable for downtime, data loss, missed leads, missed appointment requests, lost revenue, lost profits, or business interruption.

11. Disclaimer of Warranties

BookingIQ is provided "as is" and "as available" without warranties of any kind, whether express, implied, statutory, or otherwise. To the fullest extent permitted by law, we disclaim all warranties, including merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, reliability, and security.

12. Limitation of Liability

To the fullest extent permitted by law, BookingIQ and its owners, operators, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, missed appointments, missed leads, business interruption, reputational harm, or third-party claims. Our total liability for any claim related to the service will not exceed the amount you paid to BookingIQ in the three months before the event giving rise to the claim, or $100 if no amount was paid.

13. Indemnification

You agree to defend, indemnify, and hold BookingIQ harmless from claims, damages, losses, liabilities, costs, and expenses arising from your use of the service, your business content, your communications with customers, your violation of law, or your breach of these terms.

14. Updates to These Terms

We may update these terms from time to time. Continued use of BookingIQ after changes become effective means you accept the updated terms.
